These terms apply when you use breakout.ie to place a catering order. Please read them before you order. By placing an order you agree to them.
1. What Breakout is
Breakout is an online ordering system run by Breakout. It lets you send an order to a caterer and lets the caterer manage that order. Breakout does not make, sell or deliver food.
2. Who you are ordering from
When you place an order, your contract for the food and service is with the caterer named on the order page, not with Breakout. The caterer is the seller. They invoice you in their own name and under their own VAT number.
3. What your caterer is responsible for
- the menu, descriptions and prices, including VAT
- allergen information for every item
- food safety, hygiene and quality
- preparing your order and delivering it, or having it ready to collect, at the time agreed
4. Payment
You pay the caterer directly, either against a Purchase Order by bank transfer or, where offered, by card through the caterer's own payment provider. Breakout never receives or holds your money.
5. Changes, cancellations and refunds
Contact your caterer directly to change or cancel an order, ask for a refund or make a complaint. Their own cancellation policy applies. Their contact details are on their order page, on your confirmation email and on our contact page.
6. Our responsibility to you
Because your caterer prepares and delivers your order, Breakout is not responsible for late, missed or incorrect orders, the quality of the food, allergic reactions, or anything else the caterer does or fails to do.
If Breakout itself causes you a loss, for example because the website fails, our responsibility is limited as far as the law allows. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot legally be limited, and nothing affects your statutory rights as a consumer.
7. Using the website
We work to keep breakout.ie running, but we can't promise it will always be available or free of errors. If your order is urgent, contact your caterer directly as well.
8. Fair use
Please only place genuine orders. We may cancel orders that look fake or abusive, and block anyone who misuses the website.
9. Changes to these terms
We may update these terms. The version on this page when you place an order applies to that order.
10. Law
These terms are governed by Irish law, and the courts of Ireland deal with any dispute.
